 General Terms and Conditions for Promotions and Competitions

 

1. Participation restrictions.

Employees, directors, and/or officers (including immediate family members or members of the household) of Crocmedia, its subsidiaries, affiliated companies, distributors, advertising, fulfilment and promotion agencies and all other companies or entities associated with the Contest are not eligible to participate. Contest is void where prohibited or restricted by law. Participation constitutes entrant’s full and unconditional agreement and acceptance of these Official Rules which shall be final in all respects.

 

2. Entries.

All entries, once submitted, become the property of Crocmedia and shall not be returned. Any incomplete entries will not be eligible. Only one entry is allowed per person. 

 

3. Winning. 

Crocmedia shall select all winners at its sole discretion. Winner will be notified via e-mail or telephone. Crocmedia will be responsible for all applicable shipping and handling fees as well as applicable local taxes unless otherwise advised. If these rules differ from any promotional or other materials published in connection with the Contest, these rules shall control. 

 

4. Conditions. 

Prizes are non-transferable. No cash redemption or substitution will be allowed, except at Crocmedia’s sole discretion. If the prize is unavailable, Crocmedia reserves the right to substitute a prize of equal or greater value. Crocmedia also reserves the right to cancel or modify the Contest or these Official Contest Rules if fraud, technical failures or any other factor beyond Crocmedia’s reasonable control impairs the integrity of this Contest, as determined by Crocmedia, in its sole discretion. By participating, where allowable by law, the entrant grants to Crocmedia the worldwide right to publish, broadcast and use in any media, including the World Wide Web, participant’s entry, name, picture, and likeness, without limitation, for promotional and advertising purposes without additional compensation. Winner or winner’s guardian may be required, in the sole discretion of Crocmedia, to sign and return an affidavit of eligibility and a liability release within ten (10) days of the issuance of such documents or the prize may be forfeited and awarded to an alternate winner. 

 

5. Liability. 

By participating in this Contest, you (and if you are a minor, your parents or legal guardians) accept all risk and consequences of entry and participation in this Contest, and agree to release and hold Crocmedia, its officers, directors, affiliates, employees, contractors, subsidiaries, agents and partners harmless from any and all consequences, liability, losses, damages (including without limitation, consequential, punitive, incidental, special or increased damages and those related to personal injury, death or damage to property) and costs and expenses, of any kind, under any legal theory, arising from or related to this Contest, including but limited to your entry and participation in this Contest, the acceptance and/or use (or misuse) of any prize, printing errors, any claims based upon rights of publicity and invasion of privacy. Entrant shall indemnify Crocmedia, its officers, directors, affiliates, contractors, subsidiaries, agents, employees and partners from and against all claims or suits and any damages or costs (including reasonable attorneys’ fees) arising from or relating to entrant’s violation or inaccuracy of any warrantees or representations made relating to this Contest. Crocmedia assumes no responsibility for errors which may occur in the transmission of entrant’s entry. Crocmedia is not responsible for any fraud or misconduct on the part of the entrants. Should an entrant engage in fraud or misconduct of any nature, including but not limited to a violation of the Official Rules, such entrant shall be subject to immediate disqualification. Crocmedia reserves the right to terminate, modify or amend the Contest at any time if the fairness, integrity, and or proper administration of the Contest is jeopardised. IN NO EVENT SHALL CROCMEDIA BE LIABLE TO ENTRANT FOR ANY LOST PROFITS, OR FOR ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL OR OTHER INDIRECT DAMAGES ARISING OUT OF OR IN CONNECTION WITH THIS CONTEST. Entrant’s sole damages shall be limited to entrant’s actual out of pocket expenses, excluding attorneys’ fees. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, SUCH PRIZES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND CONTEST ENTITIES HEREBY DISCLAIM ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSES AND/OR NON-INFRINGEMENT.

 

6. Law. 

These terms and conditions shall be governed by, construed, and enforced in accordance with the laws of the state of Victoria, Australia without regard to any choice of law principles. Entrant hereby agrees and irrevocably consents to submit to the exclusive jurisdiction and venue of the courts of the State of Victoria and of Australia located in the State of Victoria, Australia, for any and all claims arising from or related to this Agreement. Entrant agrees that all claims relating to this Contest shall be resolved individually, without resort to any form of class action. 

 

7. Entire Agreement. 

These terms set forth the entire agreement between the parties relating to the subject matter hereof, and supersede all prior agreements and understandings relating thereto, whether oral or written. Facebook is not a sponsor nor an affiliate of this Contest.

The Promoter including without limitation technical malfunctions or failures. Dates, venues and schedules are not under the Promoter’s control and are subject to change. The Promoter takes no responsibility for any date, venue or schedule changes.

 

9. Travel.

By submitting an entry into the promotion, the entrant acknowledges and agrees to be bound by these Terms and Conditions.

1. To be eligible for entry into the promotion, entrants must (unless otherwise stated) be individuals who are over eighteen (18) years of age during the promotion period and reside in Newcastle, NSW, Australia. The promoter’s employees, management, directors & contractors, employees of entities associated with the promotion (and their immediate families) are ineligible to enter.

For clarity, “immediate families” includes any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

2. Entries to the competition are limited to one per person unless explicitly stated multiple entries are accepted at the time of entry, or a “share on social media for bonus entry” mechanic is provided.
Any unauthorised multiple entries will be removed from the electronic prize draw.

3. The promoter reserves the right to refuse entries that are wholly or partially incomplete. The promoter’s decision on this and other aspects of the promotion is final and no correspondence will be entered into. All entries become the property of the promoter.

  4. The prize-winner will be notified by e-mail and the winner’s name and suburb will also be published on the I Can Win website (http://www.icanwin.com.au/). The promoter is not responsible if the prize is late, lost or misdirected. The promoter reserves the right to use the name, likeness, image and voice (including a photograph, film or recording) of any entrant or winner in the promotion for the purpose of advertising the promotion (including its outcome), the promoter and any products or services supplied or arranged by the promoter. 

5. By entering the promotion, each entrant consents to the information they submit being entered on a database. All personal details collected by the promoter and promotional partner will be used and stored for the purposes of administration of the promotional draw and to provide the entrant with information about future promotions.

6. When a promotion is conducted in conjunction with an external company/companies ("promotional partner"), all personal details collected by the promoter will be used and stored for the purposes of providing the entrant with information about future promotions or products/services offered by the promotional partner[CG1] .

Such personal information will be dealt with by the Promoter in accordance with the Privacy Act 1988 (Cth), and the Promoter’s privacy policy which can be viewed at (http://www.crocmedia.com.au/privacy-policy).


7. The prize cannot be exchanged, transferred or altered. The promoter accepts no responsibility for any tax implications that may arise from the prize winning and independent financial advice should be sought.

8. The prize-winner acknowledges that any travel or accommodation costs incurred in relation to taking the prize is their sole responsibility – unless travel and/or accommodation is explicitly provided as part of the prize in the promotion.

9. The prize-winner agrees that neither the promoter nor any prize supplier is liable for any event, circumstance, loss or expense arising from the taking or use of a prize by the prize-winner and/or any other person. 

10. If for any reason the conduct or operation of the Promotion is interfered with or disrupted in any way (including but not limited to vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, computer bugs or viruses, tampering or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Promotion.

11. If a prize (or any part of a prize) becomes unavailable for reasons beyond the Promoter’s reasonable control, the Promoter will endeavour to provide a substitute prize of equivalent value and/or specification, subject to the written directions of any regulatory authority.

12. If a prize remains unclaimed by the redraw date listed above, the promoter reserves the right to re-award the prize in accordance with these Terms and Conditions of Entry.

13. Additions or deletions to these rules may be enacted at the discretion of the promoter at any time – including reducing or extending the promotional period.
